Q. My employer is not paying me my
wages. What should I do?
A.
In principle, a full salary must be
paid directly to workers at least once a month, on a fixed date(s). Please
consult The Labor Standards Office responsible for the area of your workplace
regarding unpaid wages.
In cases where wages are not paid
due to corporate bankruptcy, workers can secure wages based on the “system of reimbursement of unpaid wages on behalf of
business operators” in the Act on Ensuring Wage
Payment.
For matters related to the
reimbursement of unpaid wages, consult with your local Labor Standards Office.
Employment Insurance
Q. My workplace went bankrupt, and I
am no longer receiving income. Can I receive unemployment benefits?
A.
Unemployment benefits from
employment insurance are provided to insured persons who left their job due to
corporate bankruptcy, dismissal, personal circumstances, retirement age, etc.,
and who cannot find a job despite having the will and capability to work.
Benefits are provided with the objective of stabilizing their lives for a given
period of time until they find work again and to allow them to find employment
again as soon as possible. Insured persons who were forced out of jobs suddenly
due to bankruptcy, dismissal, etc. are considered unemployed workers with
specific qualifications as recipients. Unemployed workers with specific
qualifications as recipients and those unemployed due to special reasons
(unemployed persons who have completed a fixed-term employment contract without
renewal or those who have a justifiable reason) can receive these benefits as
long as they have been enrolled in employment insurance for a total of 6 months
or more and during which time there were 11 days or more that act as a basis
for the regular payment of wages during the year prior to the date of
unemployment. The procedure to receive a basic allowance (unemployment
benefits) can be conducted at your nearest Hello Work.
